The Department of Corrections has filed a post sentence petition seeking review of a sentencing decision, which the trial court has declined to alter. There appear to be no other issues in this case. The matter was stayed pending resolution of the identical issue in another case. The defendant committed an offense prior to July 25, 1999. The trial court took into account certain amendments to RCW 9.94A.120(6), the Drug Offender Sentencing Alternative, in imposing sentence. In State v. Kane, (No. 45176-6, slip opinion filed July 24, 2000, as amended by order filed August 8, 2000), this Court held that the amended eligibility criteria for an alternative sentence do not apply to crimes committed before the effective date of the amendments. In light of Kane, the stay is lifted and the matter is remanded to the trial court for resentencing.
